User License Agreement
Macro Defects in Steel, version 1.0
Licensed for use by single user.
By use of this product, either in the form of transfer to hard disk or use of the database itself, the Licensee has consented to the terms of the Software and License Agreement, which is a part of this package.
SOFTWARE & DATABASE LICENSE
1. GRANT OF LICENSE. The Macro Defects in Steel 1.0 License Agreement (“License”) permits you to use one copy of the version of the software and database product identified above (“SOFTWARE”) on only one computer at any time. If the SOFTWARE is permanently installed on the hard disk or other storage device of a computer (other than a network server) and one person uses that computer more than 80% of the time it is in use, then that person may also use the SOFTWARE on a portable or home computer.
2. COPYRIGHT. The SOFTWARE & DATABASE are owned by the Steel Data and are protected by United States copyright laws and international treaty provisions. Therefore, you must treat the SOFTWARE like any other copyrighted material (e.g. a book or musical recording) except that you may either (a) make one copy of the SOFTWARE solely for backup or archival purposes, or (b) transfer the SOFTWARE to a single hard disk provided you keep the original solely for backup or archival purposes. You may not copy the written materials accompanying the SOFTWARE.
3. OTHER RESTRICTIONS. This License Agreement is your proof of license to exercise the rights granted herein and must be retained by you. You may not rent, lease, or transfer your rights to the SOFTWARE, nor may you reverse engineer, decompile, or disassemble the SOFTWARE.
LIMITED WARRANTY
LIMITED WARRANTY. Steel Data warrants that the original copy of the SOFTWARE will perform substantially in accordance with the accompanying written materials for a period of ninety (30) days from the date of receipt. Any implied warranties on the SOFTWARE are limited to ninety (30) days. Some states/jurisdictions do not allow limitations on duration of an implied warranty, so the above limitation may not apply to you.
CUSTOMER REMEDIES. Steel Data entire liability and your exclusive remedy shall be, at Steel Data’s option, either (a) return of the price paid or (b) repair or replacement of the SOFTWARE that does not meet Steel Data’s Limited Warranty and that is returned to Steel Data with a copy of your receipt. The Limited Warranty is void if failure of the SOFTWARE has resulted from accident, abuse, or misapplication. Any replacement SOFTWARE will be warranted for the remainder of the original warranty period or thirty (30) days, whichever is longer. Neither these remedies nor any product support services offered by Steel Data are available without proof of purchase from an authorized source.
NO OTHER WARRANTIES. To the maximum extent permitted by law, Steel Data disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the SOFTWARE and the accompanying written materials. This limited warranty gives you specific legal rights. You may have others, which vary from state/jurisdiction to state/jurisdiction.
NO LIABILITY FOR CONSEQUENTIAL DAMAGES. To the maximum extent permitted by law, in no event shall Steel Data be liable for any damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or other pecuniary loss) arising out of the use of inability to use this product, even if Steel Data has been advised of the possibility of such damages. Because some states/jurisdictions do not allow the exclusions or limitation of liability for consequential or incidental damages, the above limitation may not apply to you.
